PocketBot Terms and Conditions

1. About these terms

PocketBot (“PocketBot”, “we”, “us”, “our”) is operated by Fatwax Kreatif Medya Ltd, a company registered in England and Wales (company number 17284549), registered office: 3010 Davenport House, 261 Bolton Road, Bury, Lancashire, BL8 2NZ. These Terms govern your use of the PocketBot platform and services. By using PocketBot, you agree to these Terms. If you do not agree, please do not use the platform.

2. Definitions

• “Platform” means the PocketBot website, app and associated services.
• “Customer” or “you” means the business or individual using PocketBot to manage their own customer communications, bookings, orders and payments.
• “End Customer” means a person who contacts or buys from you through your PocketBot-powered app.
• “Services” means the customer communication, booking, order management and payment tools we provide.

3. Eligibility

You must be at least 18 years old and using PocketBot for business purposes. By using the Services you confirm you meet these requirements and are authorised to act for your business.

4. Our services

PocketBot provides software that lets businesses manage customer enquiries, quotes, bookings, orders and payments through a messaging-based app. PocketBot is a software provider only. We do not sell your products or services, and we are not party to any transaction between you and your End Customers.

5. Accounts

You are responsible for the accuracy of the information you provide, for keeping your account secure, and for all activity under your account.

6. Fees and payment

Fees for the Services are as set out in the order, quote or plan agreed with you. Unless otherwise agreed, fees are quoted in pounds sterling (GBP). Payments are processed through our third-party payment providers (for example card, Google Pay, PayPal or bank transfer). You are responsible for keeping valid payment details where applicable and for any taxes that apply to your purchase.

7. Your responsibilities

• Ensure your listings, content and communications are accurate, lawful and not misleading.
• Fulfil orders and handle any disputes with your End Customers.
• Comply with all laws applicable to your business and to the goods or services you offer.

We may suspend or remove content or accounts that breach these Terms.

8. Acceptable use

You must not use the Platform for any unlawful, fraudulent, deceptive or abusive purpose; post false or offensive content; infringe third-party rights; attempt to bypass fees; or attempt unauthorised access to the Platform or its data.

9. Third-party services

PocketBot integrates with third-party services including Telegram’s API. We are not affiliated with or endorsed by Telegram and are not responsible for their availability, policies or actions. You must comply with the terms of any third-party service you use through PocketBot.

10. Intellectual property

We retain all rights in the Platform and its software. You retain rights in your own content and grant us the licence needed to provide the Services.

11. Data protection

We process personal data in accordance with our Privacy Policy and applicable UK data protection law.

12. Limitation of liability

The Platform is provided “as is”. We do not guarantee uninterrupted service. To the extent permitted by law, we are not liable for losses arising from your use of the Platform, from transactions with your End Customers, or from downtime or errors. Nothing in these Terms excludes liability that cannot be excluded by law.

13. Indemnity

You agree to indemnify Fatwax Kreatif Medya Ltd against claims, losses or damages arising from your breach of these Terms or your use of the Platform.

14. Suspension and termination

We may suspend or terminate access for breach of these Terms. Unauthorised chargebacks against valid transactions may result in suspension.

15. Changes

We may update these Terms from time to time. Continued use after changes means you accept them.

16. Governing law

These Terms are governed by the laws of England and Wales, and the courts of England and Wales have exclusive jurisdiction.

17. Severability and entire agreement

If any provision is unenforceable, the rest remain in effect. These Terms are the entire agreement between you and us regarding the Platform.
